Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Home Efficient LLC, a Delaware limited liability company operating from Florida ("Home Efficient," "we," "us," or "our"), governing your use of the website at homeefficient.energy (the "Site") and the solar lead-matching service we provide (the "Service").

By using the Site or submitting the form, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. What the Service is (and isn't)

Home Efficient is a lead-matching service. We collect information you submit through the form on the Site and share it with one or more independent local solar installers so they can prepare a quote and contact you about residential solar and battery options.

Home Efficient is not a solar contractor or installer. We do not design, sell, install, finance, or service solar systems. We do not generate quotes; the quote you receive comes from an independent installer. We do not control the installer's business practices, pricing, scheduling, or workmanship.

3. Your submissions

By submitting information through the Site, you represent that the information is accurate and that you have the right to share it. You grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and share that information as described in our Privacy Policy — including sharing it with the matched installer(s) for the purpose of preparing a quote and contacting you.

You can withdraw consent and request deletion at any time by emailing privacy@homeefficient.energy; see the Privacy Policy for the details and timelines.

4. Independent installers; no endorsement

The solar installers we match you with are independent third parties, not our agents, employees, or affiliates. Any contract for the design, sale, installation, financing, or service of a solar system is solely between you and the installer.

We screen installers using a reasonable process before adding them to our network, but our screening is not a guarantee of license status, insurance, workmanship, pricing fairness, or any specific outcome. We strongly recommend that you independently verify an installer's license, insurance, and references; obtain multiple written quotes; and read every contract carefully before signing.

We are not responsible for, and do not warrant, the conduct of any installer or the quality, safety, legality, or value of any product or service they provide.

5. Communications and contact

When you submit the form, you consent to be contacted by us and by the matched installer(s) by phone, text, and email about solar and battery options for your home, including via automated technology. The full consent language and your opt-out rights are described in Section 9 of our Privacy Policy.

Consent is not a condition of any purchase. You may withdraw consent at any time as described in the Privacy Policy. Standard message-and-data rates may apply to text messages.

The Site, including its design, text, graphics, logos, and underlying code, is owned by Home Efficient or its licensors and is protected by copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Site for its intended purpose. All rights not expressly granted are reserved.

"Home Efficient" and the Home Efficient logo are trademarks of Home Efficient LLC. You may not use them without our prior written permission.

8. Third-party services and links

The Site may link to or integrate with third-party services (such as Meta, Google, and Vercel). We are not responsible for the content, policies, or practices of those services. Your use of a third-party service is governed by its own terms and privacy policies.

9. Disclaimer of warranties

THE SITE AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, HOME EFFICIENT DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Site will be uninterrupted, secure, or error-free; that any quote you receive will reflect the lowest available price or the best available system; or that any particular installer will be available, will respond, or will perform to your satisfaction. The savings figures shown on the Site, if any, are illustrative estimates, not guarantees.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOME EFFICIENT AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You will indemnify, defend, and hold harmless Home Efficient and its officers, members, employees, and agents from any third-party claims, damages, liabilities, and reasonable costs (including attorneys' fees) arising out of: (a) your use of the Site or Service; (b) information you submit through the Site, including misrepresentations or submissions made on behalf of someone else without authorization; or (c) your violation of these Terms or any applicable law.

12. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to the informal dispute-resolution paragraph below, you and Home Efficient agree that any lawsuit arising out of or relating to these Terms, the Site, or the Service must be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction and venue of those courts.

Informal dispute resolution

Before filing a lawsuit, you agree to first contact us at hello@homeefficient.energy with a description of your dispute and the relief you seek, and to give us at least 30 days to resolve it informally. We agree to do the same with you.

Class-action waiver

To the fullest extent permitted by law, you and Home Efficient agree to bring any dispute on an individual basis only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms or pose a risk to the Service or to other users. Sections that by their nature should survive termination (including Sections 7, 9, 10, 11, 12, and 15) will survive.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes will be highlighted on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
